As imagens chocantes que se espalharam nas redes sociais e na imprensa mostram a advogada Luana Otoni de Paula cometendo agressão, injúria racial e violência contra funcionários no aeroporto de Confins, na região metropolitana de Belo Horizonte. O comportamento condenável da advogada causou repúdio e indignação em todo o país. Sua prisão foi justa.
No entanto, a decisão de ontem em suspender a inscrição da advogada Luana pela Ordem dos Advogados do Brasil em Minas Gerais (OAB-MG) tem gerado polêmica e provocado debates sobre possíveis abusos de autoridade. Afinal, os crimes pelos quais ela foi acusada e presa ocorreram em um domingo, em um momento que deveria ser de descanso.
Aparentemente não houve nenhuma conduta relacionada ao exercício da advocacia que justificasse a suspensão da inscrição profissional sem o direito adequado de defesa. Ao contrário de casos comuns, nos quais advogados tentam transportar substâncias ilícitas em presídios e cometem outras infrações ligadas à prática profissional.
O fato de a advogada ter sido punida por supostamente ter cometido crimes em um dia de folga levanta questionamentos sobre a legitimidade da ação da OAB-MG. A suspensão da inscrição profissional de um advogado por alegados crimes cometidos em um momento de lazer pode ser interpretada como uma medida excessiva e desproporcional.
Segundo a OAB, Luana estava a trabalho no Rio Grande do Norte. Ela tinha a importante missão de representar a Ordem no 5º Congresso Internacional de Moda, por isso sua inscrição profissional foi temporariamente suspensa. Relatos de testemunhas apontam que Luana teria utilizado de sua posição de advogada para tentar intimidar a tripulação dentro da aeronave. Ela deu a famosa “carteirada”.
A Ordem dos Advogados do Brasil em Minas Gerais deve garantir que a advogada em questão tenha acesso a um julgamento imparcial e transparente. Afinal, é garantido a todos o direito à defesa completa e à oportunidade de contestação.
É inaceitável que, ainda nos dias atuais, algumas pessoas se sintam no direito de agredir e menosprezar indivíduos devido à sua raça. A discriminação racial é um crime grave que precisa ser punido com todo o rigor previsto na legislação. Jornalismo não deveria ser algo impessoal e isento de opinião? Ademais: ao q foi noticiado a advogada estava representando a OAB em um evento e isso já tira a questão de cunho do que ela faz em momento de descanso. Fora que segundo as regras da ordem o advogado deve se portar exemplarmente qdo em público. Ela foi apenas suspensa e não expulsa. Tem uma diferença nisso daí.
“Jornalismo investigativo”. A inscrição da suspeita não foi suspensa. A OAB revogou a nomeação da advogada ao cargo de presidente da Comissão de Direito da Moda.
Na verdade houve a suspenção da presidência dela da comissão de direito e da moda….a inscrição como advogada está ativa .
