O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), determinou que Maria de Fátima Mendonça Jacinto Souza, a Fátima de Tubarão, comece a cumprir pena de 17 anos, em regime fechado, imediatamente. Ela foi condenada pela Corte pelo envolvimento nos atos de 8 de janeiro de 2023.
Fátima, 67 anos, foi acusada pela Procuradoria-Geral da República (PGR) e condenada pelos crimes de abolição violenta do Estado Democrático de Direito, golpe de Estado, dano qualificado, deterioração do patrimônio tombado e associação criminosa armada.
O caso foi julgado em plenário virtual, na Ação Penal nº 2.339. Além da condenação pelos crimes, Fátima de Tubarão terá de pagar R$ 30 milhões de forma solidária com os outros condenados, a título de danos materiais.
“Determino o início do cumprimento da pena de reclusão, em regime fechado, em relação à ré Maria de Fátima Mendonça Jacinto Souza. À Secretaria Judiciária para que autue, com esta decisão, procedimento da classe Execução Penal (EP) e efetue a baixa da respectiva Ação Penal (AP), devendo as petições recebidas na ação penal serem trasladadas para os respectivos autos da Execução Penal”, afirmou Moraes na decisão.
No voto que a condenou, Moraes, relator do caso, citou um vídeo em que Fátima aparece durante as manifestações em 8 de janeiro. E transcreveu um texto no qual “[…] um dos indivíduos que a acompanha chama-a por “Fátima”, afirma que ela vem de Tubarão (SC), e que estaria ali ‘quebrando tudo’
Presa na Operação Lesa Pátria
A mulher foi presa em 27 de janeiro, na terceira fase da Operação Lesa Pátria, da Polícia Federal, contra bolsonaristas que invadiram as sedes dos Três Poderes, em Brasília. Maria de Fátima ficou conhecida após viralizar um vídeo no qual aparece invadindo o Palácio do Planalto.
Ela foi condenada por tráfico de drogas, em 2012, e ainda responde pelos crimes de estelionato e falsificação de documento público em outro processo, segundo o Tribunal de Justiça de Santa Catarina (TJSC).
