Os moradores de loteamentos no município de Rio Casca, na região Zona da Mata de Minas Gerais, continuam enfrentando uma longa e frustrante batalha judicial. Após quase duas décadas desde as chuvas devastadoras em 2005, muitos ainda aguardam o pagamento de indenizações determinadas pela Justiça, com sentenças já transitadas em julgado.
Apesar de os valores devidos terem sido determinados por perícia judicial há mais de dez anos, os pagamentos, previstos em precatórios, ainda não foram efetuados, mesmo com o prazo final estabelecido para 31 de dezembro de 2024.
O impasse, que afeta famílias inteiras, se agrava com o falecimento de muitos dos moradores prejudicados, cujos herdeiros agora buscam receber os direitos que lhes foram passados.
A proposta da Prefeitura: solução ou mais um atraso
O município, responsável pela aprovação dos loteamentos onde ocorreram os danos, propôs recentemente uma alternativa para a quitação das dívidas. Em novembro de 2024, Marleide de Paula Mucida Miranda (PP), depois de eleger o seu sucessor em outubro, Raimundo da Farmácia do mesmo partido, sugeriu um “calote” no pagamento das indenizações, com uma condição que gerou revolta entre os moradores: um desconto de 40% sobre o valor devido e parcelado.
Essa proposta, formalizada por meio de um Decreto Legislativo, foi recebida com indignação por muitos dos afetados, que consideram a medida injusta e insensível. “Durante os quase 20 anos de tramitação do caso, o município não apresentou nenhuma outra oferta ou solução para os prejudicados, gerando críticas sobre a falta de compromisso com os cidadãos, disse o advogado Gustavo Pessoa
Uma luta de anos sem fim
Gustavo Pessoa, que representa algumas das famílias afetadas, expressou sua insatisfação com a condução do caso:
“A morosidade do processo judicial, somada à proposta de pagamento parcelado e com redução de 40% no valor das indenizações, demonstra uma falta de sensibilidade e compromisso com os cidadãos que foram prejudicados. Esses moradores não apenas perderam seus bens, mas também passaram anos lutando para obter o reconhecimento e a compensação devida pelos danos sofridos.”
A sensação de abandono é compartilhada por muitos dos envolvidos, que agora enfrentam a realidade de uma compensação reduzida ou até mesmo o risco de nunca receberem o valor integral determinado pela Justiça.
