O ex-presidente Jair Bolsonaro (PL) se pronunciou sobre a decisão de Alexandre de Moraes, presidente do TSE (Tribunal Superior Eleitoral) e ministro do STF (Supremo Tribunal Federal), de negar um recurso em que pedia para que sua inegibilidade fosse analisada pelo STF (Supremo Tribunal Federal). Em seu perfil no X (ex-Twitter), afirmou se tratar de uma “perseguição sem fim”. Ainda lembrou a multa de R$ 425 mil também definida em outubro de 2023.
Moraes, rejeitou o recurso extraordinário apresentado pela defesa de Jair Bolsonaro (PL) e Walter Braga Netto (PL) para que a decisão que os tornaram inelegíveis seja analisada no Supremo Tribunal Federal (STF).
Bolsonaro e Braga Netto foram condenados pelo TSE por abuso de poder político e econômico nas comemorações do Bicentenário da Independência, realizado em 7 de setembro de 2022 em Brasília (DF) e no Rio de Janeiro (RJ).
Moraes destacou que o recurso apresentado não atendeu aos requisitos previstos na legislação. Além disso, enfatizou que a decisão do TSE não violou a Constituição. “A controvérsia foi decidida com base nas peculiaridades do caso concreto, de modo que alterar a conclusão do acórdão recorrido pressupõe revolvimento do conjunto fático-probatório dos autos, providência que se revela incompatível com o Recurso Extraordinário.”
O recurso extraordinário precisa ser admitido pelo próprio tribunal onde há a decisão questionada, antes que o tema siga para o STF. Esse tipo de peça processual visa uniformizar a interpretação da Constituição Federal.
