Valor da caução calculado pelo Estado para recuperação socioambiental é 2 mil vezes menor do que o estimado pela AGU
As mineradoras que atuam em Minas Gerais têm até o final deste mês para apresentarem propostas com o valor de caução que garanta a recuperação socioambiental em casos de acidente e de desativação de barragem.
O prazo consta no decreto estadual nº 48.747 de 29/12/2023, destinado a regulamentar o artigo 7º (Inciso I, alínea b), um dos principais pontos da chamada Lei Mar de Lama Nunca Mais (nº 23.291/2019), relativo à caução ambiental pelo Estado.
Entretanto, o decreto assinado pelo governador Romeu Zema (Novo) no apagar das luzes de 2023, caso não seja revisto, em vez de repor perdas, como deve ser o seu objetivo, poderá impor prejuízos bilionários e irreversíveis ao Estado, à sociedade e ao meio ambiente.
Apesar da importância do artigo para salvaguardar um Estado repleto de barragens potencialmente destrutivas, o governo Zema protelou ao máximo a sua regularização. E ainda assim conseguiu apresentar uma proposta cheia de falhas, segundo apontam ambientalistas.
Falhas
O Instituto Fórum Permanente São Francisco (FPSF) analisou o decreto em detalhes e constatou uma “série de inconsistências, omissões, equívocos e impropriedades”.
Entre outras pontos, ele identificou que o valor de caução, resultante da fórmula de cálculo previsto pelo decreto, chega a ser até 2.006 vezes menor do que o valor estimado pela Advocacia-Geral da União (AGU) para a recuperação socioambiental, no caso do rompimento da barragem de Fundão (ocorrido em Mariana, em novembro de 2015, no subdistrito de Bento Rodrigues).
Ou seja: enquanto a AGU calcula em R$ 126 bilhões o montante necessário para a recuperação socioambiental no caso de Fundão, o governo de Minas reconhece, via decreto, a necessidade de apenas R$ 62,8 milhões.
Já no caso do rompimento da barragem do Córrego do Feijão (Brumadinho), o resultado indicado pela fórmula do decreto estadual é ainda mais gritante: ele é 2.890 vezes menor do que o valor acordado entre o governo de Minas Gerais e a Vale.
Tal falha na visão do FPSF abre espaço para que as mineradoras apresentem valores muito inferiores aos necessários para enfrentar desastres como os de Mariana e de Brumadinho.
Omissão
O decreto também, por incrível que pareça, não obriga o Estado a aplicar o valor da caução executada na recuperação socioambiental das barragens. E muito menos prevê como o emprego do valor será fiscalizado.
Com isso, para o FPSF, fica evidente que o decreto “não atende um dos principais requisitos – senão o mais importante – do artigo da lei que pretende regulamentar”.
Alerta
O vice-presidente do FPSF, Júlio Grillo, alerta para os riscos que tais falhas e omissões podem acarretar. “Caso o decreto se confirme na prática e ocorram novas rupturas de barragens (como é bem provável) o Estado de Minas Gerais, sua sociedade e o meio ambiente podem vir a sofrer prejuízos de centenas de bilhões de reais”.
“As mineradoras já podem estar apresentando suas propostas, com os valores bem menores que os realmente necessários e, mesmo se o decreto for anulado, talvez possam alegar direito adquirido”, disse.
Segundo ele, é necessário que a sociedade se mobilize para exigir que a caução prevista na Lei Mar de Lama Nunca Mais seja corretamente regulamentada.
Confira as principais falhas identificadas no Decreto nº 48.747/23 (*):
* O valor de caução resultante da fórmula de cálculo do decreto é 2 mil vezes menor que o valor estimado pela AGU para a recuperação socioambiental no caso do rompimento da barragem de Fundão.
* 2.890 vezes menor que o valor do acordo do governo de MG com a Vale para o caso do rompimento da barragem do Córrego do Feijão (Brumadinho).
* A fórmula de cálculo do decreto aplica-se apenas ao fechamento da barragem de rejeitos comuns (de ferro, por ex.), de acordo com a Dissertação de 2010 em que foi estabelecida.
*O fechamento de barragem de rejeitos sulfetados (de ouro, por ex.) pode ser até 9 vezes mais caro, de acordo com a Dissertação, que não prevê valor para rejeitos radioativos e outros tóxicos.
* O decreto não obriga o Estado a empregar o valor da caução executada na recuperação socioambiental das barragens nem prevê como o emprego do valor será fiscalizado.
