O plenário do Supremo Tribunal Federal (STF) formou maioria para manter a pena de oito anos e dez meses de prisão para Fernando Collor, ex-presidente da República, pelos crimes de corrupção passiva e lavagem de dinheiro. O julgamento está acontecendo no plenário virtual, onde cada ministro deposita seu voto separadamente no sistema, sem debate. Dos 11 magistrados da Corte, seis já votaram para rejeitar os recursos protocolados pela defesa de Collor, enquanto dois se manifestaram a favor dos argumentos da defesa.
O caso é relatado pelo ministro Alexandre de Moraes, que se posicionou pela rejeição dos recursos. Os ministros Edson Fachin, Flávio Dino, Cármen Lúcia, Luís Roberto Barroso e Luiz Fux acompanharam o relator. Dias Toffoli e Gilmar Mendes divergiram, propondo a redução da pena para quatro anos de prisão. Restam os votos de André Mendonça e Nunes Marques. Cristiano Zanin está impedido de votar no caso.
A investigação foi um desdobramento da Operação Lava Jato. A condenação de Collor foi imposta em maio do ano passado, juntamente com a de outros dois réus. Desde a publicação do acórdão, em setembro, os réus interpelaram a decisão com embargos, os quais foram respaldados pela Procuradoria-Geral da República (PGR). Os embargos são um tipo de recurso utilizado para esclarecer obscuridade, omissão ou contradição na decisão.
Se a pena for confirmada em oito anos e dez meses de prisão, o ex-presidente terá de começar a cumpri-la em regime fechado. Penas até quatro anos podem ser cumpridas em regime aberto. Quando a punição imposta fica entre quatro e oito anos, se o condenado não for reincidente, pode começar a cumprir sua pena no regime semiaberto.
Collor foi condenado por corrupção passiva e lavagem de dinheiro, em um esquema envolvendo a BR Distribuidora, um dos alvos da Lava Jato. Os outros dois réus – Pedro Paulo Bergamaschi de Leoni Ramos, acusado de ser o operador do esquema, e Luis Amorim, diretor executivo da Organização Arnon de Mello – receberam penas de quatro anos e um mês, e três anos e dez dias, respectivamente. Todos os réus negaram as acusações durante o julgamento.
