A Justiça Federal em Minas Gerais aceitou a denúncia do Ministério Público Federal (MPF) contra seis pessoas acusadas de integrarem uma organização criminosa que praticava estelionato por fraudes nos sistemas da Receita Federal do Brasil (RFB).
A investigação, realizada pela Polícia Federal (PF) na Operação Inflamável, descobriu que o grupo oferecia serviços de “inteligência tributária” por meio da empresa de consultoria Tributary. Os principais alvos do grupo eram clientes varejistas, como postos de combustíveis, sob a promessa de restituições tributárias da Receita Federal.
Estima-se que os acusados tenham causado um prejuízo de R$ 348 milhões aos cofres públicos por meio das restituições tributárias indevidas oferecidas pela empresa. Os delitos resultaram em grandes perdas financeiras para o Governo e para os clientes da empresa Tributary, de acordo com a acusação do MPF. A suposta organização criminosa que controlava a empresa teria se especializado em práticas fraudulentas ao manipular os sistemas de créditos tributários e de solicitação de restituição tributária da Receita Federal, com o intuito de obter reembolsos indevidos de PIS e Cofins em nome de seus clientes.
De acordo com o MPF, o grupo inseriu indevidamente créditos tributários falsos, sem origem legal, no montante de R$ 3,69 bilhões, em favor de várias pessoas. Dessa quantia, R$ 348 milhões foram indevidamente recebidos por 196 clientes da firma de consultoria Tributary.
As investigações iniciaram após o contador de um grupo empresarial, que havia contratado uma consultoria tributária, procurar a Polícia Federal para informar sobre um depósito de R$ 9 milhões na conta de seus clientes. Para o MPF, duas empresas estavam envolvidas: a Correct Tax Consultoria Tributária Ltda (também conhecida como Tributary) e a Solutions Tributary Ltda. Enquanto a primeira empresa fazia a abordagem aos clientes e firmava os contratos, a segunda realizava os pedidos de restituição.
A Tributary se apresentava como especialista em recuperação de créditos e inteligência tributária, prometendo teses tributárias consolidadas na Jurisprudência. Os clientes, confiantes na seriedade da consultoria, assinavam contratos concordando em pagar 30% dos valores restituídos. A empresa, então, enganava a Receita por meio de códigos residuais e software para lançar informações falsas nas escriturações digitais.
As empresas se aproveitavam de uma falha no sistema de restituição para o golpe passar despercebido. Quando questionada sobre os valores elevados a serem restituídos, a Tributary alegava segredo profissional para sustentar a fraude.
A Receita, a partir do segundo semestre de 2022, iniciou procedimentos para que os contribuintes pudessem corrigir as informações falsas sem multas. No entanto, muitas empresas não aceitaram essa proposta de solução por confiarem na consultoria tributária e, por essa, se recusar a devolver parte da restituição recebida, o que resultou em multas pesadas e endividamento das empresas.
