O desembargador Ricardo Machado Rabelo, vice-presidente do TRF-6, está prestes a dar uma solução para o acordo envolvendo as vítimas, mineradoras, estados e municípios afetados pelo desastre de Mariana em 2015. As negociações estão em andamento desde 2021, agora sob responsabilidade do TRF6. Machado lidera a repactuação do caso Samarco, que já se arrasta há três anos.
Uma reunião sobre o acordo há duas semana em Brasília. Ainda estão pendentes as definições sobre os valores das indenizações individuais e a retirada de rejeitos do fundo do Rio Doce, por exemplo.
O relator do caso no TRF-6, desembargador Ricardo Rabelo, disse a interlocutores que espera fechar o acordo antes do processo judicial que corre na Inglaterra desde 2020, cujo julgamento está marcado para outubro.
O desastre ambiental de Mariana afetou 1,5 milhão de pessoas e matou 19. O Instituto Brasileiro do Meio Ambiente e dos Recursos Naturais Renováveis (Ibama) apontou que ao menos 400 espécies animais e vegetais foram impactadas.
O governador do Espírito Santo, Renato Casagrande (PSB), disse ontem que o acordo de repactuação pelo desastre de Mariana (MG) deve ser resolvido até o fim do ano. Segundo ele, que conversou com jornalistas depois de se reunir com o presidente Luiz Inácio Lula da Silva (PT) no Palácio do Planalto, os valores do acordo devem ficar próximos a R$ 100 bilhões.
Em 11 de junho de 2024, a BHP, Vale e Samarco apresentaram uma nova proposta para fechar o acordo: R$ 82 bilhões em repasses aos governos federal, de Minas Gerais e do Espírito Santo para reparar os danos causados. Trata-se de um aumento de R$ 10 bilhões na comparação com as duas propostas anteriores das mineradoras (R$ 72 bilhões). Ainda assim, é um valor menor do que o pedido pelo governo federal e os Estados envolvidos numa contraproposta feita em 6 de junho, quando foram solicitados R$ 109 bilhões em dinheiro novo.
Segundo Casagrande, a proposta final deve ficar próxima dos R$ 100 bilhões e já tem o aceite de Minas Gerais e do Espírito Santo. Para ele, faltaria colocar recursos para a duplicação de parte da BR-262 nos termos do acordo. As negociações se arrastam há mais de 2 anos e meio. Foram paralisadas em 2022 com o fim do governo Jair Bolsonaro (PL) e retomadas em março de 2023 com a gestão petista. No atual governo, a Casa Civil coordena a negociação junto com a AGU (Advocacia-Geral da União). Ambas estavam presentes na reunião com Casagrande e Lula.
