O Supremo Tribunal Federal (STF) decidiu analisar se a Lei nº 6.683/79 – conhecida como a Lei da Anistia – abrange crimes de ocultação de cadáver, cometidos durante a ditadura militar e que permanecem sem solução. O julgamento foi concluído no plenário virtual, em 14 de fevereiro.
No recurso se discute a viabilidade do recebimento da denúncia do Ministério Público Federal do Pará, formalizada em 2015 contra os tenentes-coronéis do Exército Lício Augusto Ribeiro Maciel e Sebastião Curió Rodrigues de Moura, acusados de homicídio e ocultação de três cadáveres, opositores ao regime militar. Os fatos aconteceram entre os anos de 1973 e 1976, durante a guerrilha do Araguaia, movimento armado envolvendo os militantes do Partido Comunista do Brasil (PC do B).
A decisão torna o caso emblemático, pois abre a possibilidade de punições penais sobre atos criminosos praticados no regime de exceção, reabrindo feridas não cicatrizadas pela transição democrática.
O Ministro Flávio Dino, relator do caso, votou pela viabilidade da discussão sobre o alcance da Lei da Anistia diante do caráter permanente do crime de ocultação de cadáver, reconhecendo a repercussão geral da matéria. A posição do Relator foi acolhida por unanimidade e a decisão de mérito, a ser tomada em novo julgamento ainda a ser designado, terá que ser seguida, em casos semelhantes, pelas demais instâncias do Poder Judiciário.
O Relator argumentou em seu voto que não se cogita proceder a revisão do posicionamento quanto ao reconhecimento da validade da Lei da Anistia em relação à Constituição Federal de 1988, tendo em vista a decisão tomada pelo próprio Supremo, em 2010, na Ação de Descumprimento de Preceito Fundamental (ADPF) 153. Pretende-se, realçou o Ministro, deliberar se os apontados crimes de caráter permanente são ou não alcançados pela anistia.

A legislação penal não define o que seja crime permanente. Doutrinadores do direito esclarecem que crime permanente é aquele em que a execução se prolonga no tempo, de acordo com a vontade do agente. Ocorridas ocultações cujos corpos sequer foram localizados, as práticas criminosas ainda estariam em curso, sendo esse ponto jurídico de especial relevância no julgamento a se realizar.
Relatório da Comissão Nacional da Verdade, publicado em 2014, aponta 434 mortos e desaparecidos políticos no Brasil, adotando os parâmetros da Lei nº 9.140/95. Esta Lei reconhece como mortas as pessoas desaparecidas em razão de participação, ou acusação de participação, em atividades políticas, no período de 2 de setembro de 1961 a 15 de agosto de 1979, contudo não admite a responsabilidade do Estado nas práticas.
A questão debatida supera o interesse meramente jurídico e constitui um dos casos de maior destaque em tramitação no Supremo Tribunal. O Ministro Relator, ao se pronunciar no julgamento do recurso, considerou a repercussão da matéria relacionada com a maneira como o país enfrentou sua história.

A decisão do Supremo traz mais um ingrediente de tensão no ambiente político e institucional, principalmente pelas investigações sobre os fatos do dia 8 de janeiro de 2023, que tratam da invasão e depredação, por centenas de pessoas, do Congresso Nacional, Palácio do Planalto e Supremo Tribunal Federal. Militares das Forças Armadas e o ex-Presidente da República Jair Bolsonaro, assim como pessoas próximas ao seu entorno político íntimo, são alvos das investigações, podendo ser denunciados formalmente pelo Procurador-Geral da República.
