A Empresa de Correios e Telégrafos (ECT) comunicou ao Tribunal Superior do Trabalho (TST) a desistência de recursos e a renúncia a prazos recursais em 3.781 processos que estavam em trâmite no TST. Entre esses processos, um deles, no valor de R$ 614 milhões, foi movido pela Federação Nacional dos Trabalhadores em Empresas de Correios e Telégrafos (Fentect), que reivindicava o pagamento do Adicional de Atividade de Distribuição e Coleta (AADC) aos funcionários da estatal.
Essa medida é resultado de um Acordo de Cooperação Técnica firmado entre os Correios e o TST, que tem como objetivo reduzir o número de processos e promover a prevenção de litígios. A mudança de postura dos Correios, que historicamente evitavam acordos desse tipo, ocorreu após a entrada de Fabiano Silva dos Santos na presidência da estatal em fevereiro de 2023, substituindo o general Floriano Peixoto. A nova administração adotou uma abordagem mais dialogada, em contraste com a gestão anterior, que havia retirado 40 cláusulas do Acordo Coletivo de Trabalho.
A estatal explicou que o valor da ação trabalhista não foi registrado como prejuízo em 2023, mas lançado retroativamente no balanço de 2022, devido a “erros contábeis” na classificação da ação. Sem consultar a Advocacia Geral da União (AGU) ou gerar pareceres jurídicos, a presidência decidiu alocar o passivo de mais de R$ 600 milhões nas contas da gestão anterior, do governo Bolsonaro. A ação da Fentect foi iniciada em 2015, durante o governo Dilma Rousseff.
Esse tipo de decisão é raro no setor privado, onde as empresas geralmente esgotam todas as instâncias legais para tentar reverter prejuízos, especialmente em valores elevados como os R$ 600 milhões da ação. Embora órgãos governamentais possam desistir de recursos em certos casos, amparados por leis e portarias, não há obrigatoriedade de desistência enquanto ainda houver opções de recurso disponíveis.
