Apesar do otimismo do jogador, o projeto enfrenta críticas severas de ambientalistas. Eles alertam para os riscos ambientais e sociais de um empreendimento dessa magnitude em áreas sensíveis do litoral. O relator da PEC, senador Flávio Bolsonaro, tem se empenhado para aprovar a proposta, apesar das críticas e dos riscos apontados por especialistas. A emenda, se aprovada, permitirá a privatização de áreas da União no litoral, o que pode alterar significativamente a dinâmica das propriedades costeiras no Brasil.
A PEC prevê o fim da propriedade exclusiva da União sobre terrenos de marinha. Ela foi tema de audiência pública na Comissão de Constituição e Justiça (CCJ) do Senado na última segunda-feira.
