Um dia antes da operação que cumpriu mandados de busca e apreensão contra o jogador do Flamengo Bruno Henrique, nessa terça-feira (5/11), o juiz Fernando Brandini Barbagalo, da 7ª Vara Criminal de Brasília, negou dois pedidos feitos pela Polícia Federal e pelo Ministério Público do Distrito Federal e Territórios (MPDFT).
Os órgãos queriam que a Justiça expedisse um mandado de busca e apreensão para que ele pudesse ser revistado em via pública. Também foi solicitada autorização para buscas em qualquer quarto de hotel em que o atleta pudesse estar.
Em sua negativa, o juiz Barbagalo alegou que a medida poderia afetar outros atletas:
“O Representado é jogador de futebol afamado, atleta de clube nacionalmente conhecido, estando na disputa títulos em campeonatos de nível nacional e a medida, caso autorizada nos moldes propostos, pode afetar outro(s) atleta(s) que esteja dividindo quarto com o Representado e todos os demais atletas e componentes da delegação, além de obviamente ter potencial para causar tumulto no hotel, caso existam torcedores no local ou nas imediações”.
Sobre a busca em via pública, disse o magistrado:
“Igualmente, o pedido de autorização de busca e apreensão em revista pessoal contra o Representado em via pública, igualmente, deve ser afastado, pois, além de expor indevidamente o Representado, como afirmando anteriormente, pessoa pública, poderá ser realizada no curso da busca domiciliar já autorizada”.
Bruno Henrique e outras pessoas, incluindo seu irmão, sua cunhada e uma prima, são investigados por, supostamente, terem organizado um esquema de ganhos em apostas. O trio e outras pessoas apostaram em três casas do ramo que o jogador levaria um cartão amarelo em partida do Flamengo contra o Santos, em novembro do ano passado. As contas foram criadas menos de 24 horas antes do confronto, e as apostas foram no valor máximo permitido pelas plataformas.
